Mission:
The mission of Wilderness Fringe is to enhance the public's appreciation
for the natural environment, support individuals working to sell outdoor
imagery, and provide photo buyers with a robust selection of the finest images
through a unique Internet marketplace for the liberal exchange of adventure and
nature photography.
Services:
Wilderness Fringe (“WF”) provides qualified photographers with:
1) An account to store and publish images on-line.
2) A mechanism to title, keyword, describe, and set print prices for each image.
3) Automated creation of web pages for each image, optimized for search engines.
4) A customizable Web Page at http://wildernessfringe.com/photographersname.
5) Scanning and image processing services for photographers to sell prints online.
6) Key wording services to enter important data for any image.
7) An online marketplace shared with other outdoor
photographers.
Becoming a WF
Photographer:
WF photographers are selected based on an initial submission of the photographer's work, and based on the photographer's interests and skills including:

Demonstrated marketability
·
Growth in position and dedication to the outdoor photography
industry
·
Skills in scanning and digital file preparation
·
Strength of portfolio
The initial submission will be mailed to:

And will
include:
1)
20 high-resolution digital images on CD. Each image must be consistent with the
content guidelines provided below.
2)
A short (no more than 600 word) photographic biography to be used both for the
photographer's homepage, and to assess the photographer's suitability for
Wilderness Fringe.
3)
A signed and dated copy of this document.
4) A self addressed,
stamped envelope to return the photographer’s CD.
Once the initial submission is received, Wilderness Fringe
will either accept or reject the photographer.
Upon acceptance, Wilderness Fringe will notify the
photographer, and the photographer will pay Wilderness Fringe the initial
set-up fee.
When Wilderness Fringe receives the set-up fee, the
photographer will be contacted about how to set up the personal account.
Wilderness Fringe will then select some images from the CD.
Wilderness Fringe may select up to 10, but may select fewer images. Wilderness
Fringe will keyword and upload these selected images to the account.
WF Content:
WF photographers manage their online image collections by
uploading and deleting images and by changing keywords, titles, descriptions,
prices, etc. for the images. With this privilege comes the understanding
that WF maintains control of the content of the web site.
Images:
The photographer agrees that any image uploaded to the Wilderness Fringe is the property of the photographer and will be either Outdoor Adventure or Nature photography as defined below. Generally, every image must:

Be beautiful, of high quality, and prepared to look its best
on the Web.
·
Serve to promote a healthy interaction between people and wilderness.
·
Be strong and marketable.
·
Be of broad, general appeal.
Outdoor adventure photography must:
·
Show some form of non-mechanized recreational interaction
between humans and wilderness, or have a strong enough suggestion of the
interaction that the intent is clear.
Nature Photography must:
·
Be striking, unique and serve to promote a healthy
relationship between people and the natural world.
·
Not contain any trace of human activity. Such traces include
trails, roads, structures, obviously cultivated flora or blatantly domesticated
animals.
Text:
The photographer understands that the text entered by each
photographer is published on the web, and agrees that there will be no spelling
and grammatical errors, no use of profanity, nor any misleading or false
information.
WF maintains control of the content of the web site.
WF reserves the right to alter or delete any written content
or delete any image submitted by any photographer to WF or to terminate a
photographer's account entirely for any reason.
Reasons for editing a photographer's submitted content, or
terminating a photographer's account may include, but are not limited to:
Uploads:
Each WF account comes with space for 15 images total. WF photographers may contact WF for an increase in this amount.
Fees:
WF charges the photographer a set-up fee to establish an account. This fee covers the initial services of establishing the account, image processing and key wording. This fee does not represent an annual subscription nor does it ensure a year's worth of service from Wilderness Fringe. After the work of establishing the account is completed, this fee is not refundable.
After one year with Wilderness Fringe, WF charges a $95.00 annual fee to maintain an account. Photographers will be billed annually.
WF charges the WF photographer a percentage taken from all
sales made through WF.

Fine art prints: Wilderness Fringe sells prints
at prices defined by the photographer. From this total price, WF takes a
Fulfillment Fee ( "Fulfillment Fee" ). The Fulfillment Fee may vary
as printing prices change, and reflects the cost of physically printing the
digital file. The following amount is a current estimate of the Fulfillment
Fee: 8x10 = $6.30, 16x20 = $15.40. WF will collect a Transaction Fee from the
remaining profit (“Transaction Fee”) of either $5.00 or 45%, whichever is
greater. The photographer's profit is the remainder. The photographer will be
paid quarterly the sum of his/her profit made through print sales.

Stock photography sales, Assignment
work: The photographer agrees that any contact through the Wilderness
Fringe web site that results in the purchase of rights to use an image, or the
attainment of an assignment or contract, WF will be paid 30% of the total sum
paid ultimately to the photographer. It is the responsibility of the
photographer to pay Wilderness Fringe no later than one week after payment from
the client. WF photographers not following this procedure will be removed from
the Wilderness Fringe Web Site. The photographer will pay the
above commission to:

Image Copyright:
WF operates on a unique model for the use and distribution
of images on the Internet. The copyright presented to all visitors is:
Wilderness Fringe is not the owner of any of the images displayed on this Web site. The sole owner rights for every photograph displayed at Wilderness Fringe is the photographer whose name is either printed on the image itself, or printed just below. All of the images at Wilderness Fringe are copyrighted original works of art and are protected by United States and international copyright law.
The images displayed are provided free for use under
the following conditions:
1. The images must be used only for personal, non-publishing, noncommercial
use such as use as computer wallpaper, or to print out for home use.
2. They will not be altered in any way including the removal or alteration
of the printed information containing the photographer's name and the URL for
Wilderness Fringe.
3. Comps: The 350 pixel images and the 800 pixel enlargements may be used
without consent for layout purposes. The 800 pixel versions are available only
for those images that photographers have allowed.
If you would like to use any image for a purpose other than those stated
above, please contact the photographer with the email link provided to
negotiate licensing terms for the rights to use any of the images on the
Wilderness Fringe web site.
Such uses include:
1. In any printed publication
2. Any use on the web
3. Any form of distributed media (through emailing, paper cards, etc.)
Protecting the Photographer's Images:
WF does the following to protect photographers from unlawful
uses of image displayed at WF:
By agreeing to display images at WF, the photographer accepts the copyright notice, accepts the established uses of the images by WF as outlined in this document, and accepts all risks associated with publishing photography at WF. WF is not responsible for any copyright infringements and disputes that may occur between a photographer and a user of the photography on WF.
E-mail Address:
Every image displayed at WF will have a web-based e-mail
link to the photographer. A copy of any e-mail sent to the photographer
via that link will be sent to WF, and a copy will be sent directly to the
photographer. The e-mail link is being provided for commercial inquiries.
WF reviews any e-mail sent to a photographer at WF via the e-mail link
provided. WF will contact the photographer regarding any email that may result
in a sale, assignment or contract.
Ownership of the Images:
All images posted on the Wilderness Fringe site (“Content”) are owned by the photographer who uploaded them. It is understood that WF is a licensee of the digital images displayed and sellable through the WF web site for the purposes of publishing the Content on the Internet and producing and selling fine art prints through the Internet. WF is authorized by the WF photographer to sell the Content over the Internet as fine art prints at prices the WF photographer defines. Additionally, WF is authorized by the photographer to publish the images on the WF web site. WF, the printing business and the customer shall have title to the physical prints of the Content.
Printing:
High resolution scans and some file preparation is required
for printing. The photographer is solely responsible for the quality of the
digital file used to print. WF is not responsible for any quality assurance procedure
related to the Quality of the Content, such as but not limited to profiling,
color correction, brightness adjustment, sharpening, or check of file size and
resolution, unless WF has been paid to provide such services. WF, or the
business contracted to do the printing and shipping may, at its discretion, adjust
any digital file for improved technical quality of a print delivered to customers,
but will not alter the subject of the Content.
Returned Prints:
If a customer returns a print, WF will make an assessment
regarding the reason that the print has been returned. If WF determines that a
print is returned due to inadequate Quality of the Content as defined above,
the photographer will be responsible for paying WF the Fulfillment Fee for the
returned print. The print will become the property of the photographer.
This Document:
This document and the services offered by Wilderness Fringe
will change over time. Photographers will be notified by e-mail of any
significant changes, and if necessary, a new version of this document will be
sent to each of the photographers.
Signature:
As a potential Wilderness Fringe photographer, the
undersigned has read, understands and agrees to all of the terms and conditions
stated above.
